Terms of Service + Waiver

Welcome to SCLPT LLC ("we," "us," or "our"). These Terms of Service ("Terms") outline the rules, regulations, and conditions for your participation in our fitness classes, workshops, and events, whether in-person or virtual. By booking a class or engaging in any services, you confirm that you have read, understood, and agreed to these Terms.

Please read carefully before participating. If you do not agree, do not use our services.

1. Scope of Agreement

These Terms, alongside any policies referenced herein, constitute a binding agreement between you (the "Client") and SCLPT LLC. Your participation in any class, workshop, or event, or your purchase of a class package, signifies your acceptance of these Terms.

2. Studio Policies

Health and Safety

  • By participating in any activity at SCLPT Studio, you affirm that you have been examined by a physician within the past year and are in good physical health, capable of performing exercises safely.

  • If you have not undergone such an examination, you assume all risks and responsibilities for your participation.

  • You acknowledge that heated classes at SCLPT Studio may exceed 100°F and that participation is at your own risk.

Age Restrictions

  • You must be 18 years or older to attend classes or events at SCLPT Studio.

  • SCLPT Studio reserves the right to request a valid driver's license or government-issued photo ID to verify your age.

 

Assumption of Risk and Release of Liability

You acknowledge that participation in fitness activities may involve inherent risks, including but not limited to physical injuries, heat-related conditions, and other unforeseeable incidents. By participating, you voluntarily:

  • Assume all risks of injury or harm arising from your participation.

  • Release SCLPT Studio, its owners, employees, instructors, contractors, and affiliates from any claims, liabilities, or demands resulting from your participation.

This waiver applies to personal, bodily, or mental injury, and economic or property loss. This release is binding on you, your heirs, and legal representatives.

Pregnancy and Postpartum

  • Heated classes are not suitable for pregnancy due to the potential risks of elevated core body temperature. Please consult us for non-heated class options.

  • Notify the instructor of any physical conditions, including postpartum recovery, injuries, or sensitivities, before class.

 

3. Class Policies

Cancellations

  • Classes may be canceled up to 8 hours before the scheduled start time without penalty.

  • Cancellations or changes made within 8 hours of your class time will result in the loss of that class credit. If you do not show up for your class AND did not cancel your reservation, you will incur a $15 fee and lose that class credit.

 

Payment Policy

  • SCLPT Studio is a cashless business. All payments for classes, workshops, events, merchandise, and other services must be made using credit/debit cards or approved digital payment methods.

Refunds and Returns

  • All purchases (including class packs, memberships, workshops, and events) are non-refundable, non-transferable, and non-exchangeable unless required by law.

  • All merchandise purchases are final sale. 

Workshops and Events

  • Payments for workshops and events are non-refundable once booked.

 

4. Personal Belongings

SCLPT Studio is not responsible for lost, stolen, or damaged personal items. Clients are encouraged to store belongings securely and assume all risks related to personal property.

 

5. Non-Recording Agreement

You agree not to record or transmit any portion of SCLPT Studio’s classes or activities (video, audio, still photography, or streaming) without prior written permission from authorized studio management.

You may capture personal, lawful, and non-offensive content before or after class with the consent of all individuals involved.

Any violation of this policy may result in suspension of participation and potential legal action.

 

6. Non-Harassment Policy

SCLPT Studio is committed to fostering a respectful and inclusive environment. Harassment, inappropriate conduct, or offensive behavior will not be tolerated.

If you experience or witness such behavior, report it to manager@sclptstudio.com with detailed information (e.g., date, time, incident description). Reports will be treated confidentially to the extent possible while allowing for proper investigation.

 

7. Intellectual Property Rights

All content provided by SCLPT Studio, including text, graphics, logos, and trademarks, is the exclusive property of SCLPT Studio and is protected under applicable intellectual property laws. You agree not to copy, reproduce, distribute, or exploit our content without express written consent.

 

8. Modifications to Terms

We reserve the right to amend these Terms at any time. Changes will be effective upon notice via email, website updates, or other reasonable methods. Your continued use of our services constitutes acceptance of the modified Terms.
